By accessing or using any services provided by Five Star Roadside (“Company,” “we,” “us,” or “our”), including our website, phone services, and SMS communications, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
Five Star Roadside provides emergency roadside assistance services including but not limited to: jump starts, tire changes, car lockout assistance, battery replacement, and emergency gas delivery.
3. SMS Communications
3.1 Transactional Messages
When you request roadside assistance, you may optionally opt in to receive informational SMS notifications via our booking form. This opt-in is entirely voluntary and not required to receive roadside assistance services. Messages may include technician dispatch confirmations, estimated arrival times, service completion notifications, and payment links..
3.2 Marketing Messages
By checking the optional SMS marketing consent checkbox on our booking form, you agree to receive promotional SMS messages from Five Star Roadside, including special offers, discounts, and promotions. This opt-in is entirely voluntary and not required to receive roadside assistance services.
3.3 Opt-Out
You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further messages will be sent. For help, reply HELP.
3.4 Message Frequency
Message frequency varies based on your service activity and communication preferences.
3.5 Message and Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan.
3.6 No Sharing of SMS Consent
Mobile opt-in consent and phone numbers collected for SMS communications will not be shared with third parties or affiliates for marketing or promotional purposes.
4. Payment Terms
Payment is due upon completion of service. By requesting service, you authorize Five Star Roadside to charge the agreed-upon flat-rate service fee. All fees are disclosed prior to service commencement.
5. Service Availability
We make every effort to dispatch a technician promptly, but response times may vary based on technician availability, weather conditions, traffic, and geographic location. We do not guarantee specific arrival times.
6. Limitation of Liability
Five Star Roadside shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use our services. Our total liability shall not exceed the amount paid for the specific service in question.
7. Indemnification
You agree to indemnify and hold harmless Five Star Roadside, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
8. Privacy
Your use of our services is also governed by our Privacy Policy, available at https://www.fivestarroadside.com/privacy-policy/. By using our services, you consent to the practices described in our Privacy Policy.
9. Changes to Terms
